LAW 700 - Estate Planning
Description for the DAY section of Estate Planning: This course will focus on estate planning using wills and trusts. Students will learn how to draft various types of will and trust provisions, as well as the underlying reasons why those provisions are drafted in certain ways, and how to choose the most effective provision for a client. Students will also learn about relevant tax considerations. Topics will include residuary dispositions in trust, marital dispositions, how to best define the beneficiary’s interest in a trust, creditor’s rights, trustee succession, and fiduciary powers. Students will have a chance to practice their drafting, including the use of cutting-edge drafting software. Prerequisite:Wills or permission of the instructor. Recommended: Federal Estate & Gift Tax Enrollment limited to 12 students. Description for the EVENING section of Estate Planning: This course provides an overview of the application of laws and implementation of practices pertaining to estate planning. The topics of wills, trusts, transfer taxes and the probate process are considered in their relevance to one another in the planning process. Students are given a topical outline of laws and applications, and will be asked to apply it to different planning situations, both during in-class discussions and presentations and out-of-class assignments. Examples of class discussions will range from the future of the transfer tax system to the importance of powers of attorney and health care proxies to the existence and importance of various types of trusts to an estate. Prerequisite: Wills or permission of the instructor. Recommended: Federal Estate & Gift Tax
