LAW 797J - Environmental Law Seminar: Environmental Dispute Resolution ( Theory)
The course is designed to explore the common characteristics of environmental disputes and the range of resolution options from rights-based approaches, such as litigation and appellate advocacy, to interest-based approaches, such as consensus building, mediation and facilitation. In addition, the course will examine the roles that lawyers can play in these varied approaches. A major theme of this course will be to compare the advantages and disadvantages of adversarial and collaborative approaches in environmental conflicts. Prerequisite: Environmental Skills & Practice
